Privacy Policy

Effective Date of Policy: November 1, 2019

Introduction

This Privacy Policy (“Policy”) exists to inform users of the Big SNOW American Dream website and the Big SNOW mobile application about the way that Big SNOW American Dream (the “Company” or “Big SNOW”) collects, uses, and shares personal information. Please read the following information carefully and take it into consideration when deciding whether to share your personal data with us.

What is Personal Data?

For the Company’s purposes, personal information may include your name, title, company or organization, home and/or business address, email, phone numbers, and credit card information. In addition, “personal data” is defined in the General Data Protection Regulation 2017 and any successor legislation. 

Purposes for Collection of Personal Information.

Big SNOW will identify the purpose for which personal information is collected at or before the time the information is collected or, when appropriate, at or before the time the personal information is used for a new purpose.

We will collect your personal information to establish and maintain a responsible relationship with customers; to understand needs and preferences of individuals; to develop, enhance, market and/or provide products and services; to manage and develop Big SNOW’s business and operations including transfer of data among affiliated entities; and to meet legal and regulatory requirements.

Collection of Personal Information.

Personal information that we may collect includes your name, title, company or organization, home and/or business address, email, phone numbers and credit card information, or other personal data as defined above. Personal information excludes certain information such as publicly available information. This website may collect certain information about your site visit including the name of the internet service provider and the Internet Protocol (IP) address through which you accessed the internet; the date and time you accessed our website; the pages that you accessed while on our site; and the internet address of the website from which you linked to our website. Federal COPPA (Children’s Privacy Protection Act) regulations prohibit solicitation by email of any youth 13 years old and younger and requires any subscriber to email newsletters and/or mailing lists to be at least 14 years of age.

Consent.

Consent is defined as voluntary agreement with the collection, use and disclosure of personal information for defined purposes. Consent must be express and can be provided directly by the individual or by an authorized representative. Express consent can be given orally, electronically or in writing.

In obtaining consent, Big SNOW shall use reasonable efforts to ensure that an individual is advised of the purposes for which personal information will be used or disclosed. Purposes shall be stated in a manner that can be reasonably understood by the individual. Big SNOW will seek consent to use and disclose personal information at the same time it collects the information. Big SNOW will require individuals to consent to the collection, use or disclosure of personal information as a condition of the supply of a product or service only if such collection, use or disclosure is reasonably required to fulfill the identified purposes.

Disclosure of Personal Information.

Only Big SNOW employees with a business need to know, or whose duties reasonably so require, are granted access to personal information about individuals. Big SNOW may disclose an individual’s personal information to a person who in the reasonable judgment of Big SNOW is seeking the information as an agent of the individual; a company or individual employed by Big SNOW to perform functions on its behalf, such as but not limited to research or data processing; another company or individual for the development, enhancement, marketing or provision of any of Big SNOW’s products and services; an agent used by Big SNOW to collect the individual’s account; a public authority or agent of a public authority, if in the reasonable judgment of Big SNOW it appears that there is imminent danger to life or property which could be avoided or minimized by disclosure of the information; another entity as part of a merger, a sale of assets or all or part of a business, or any other corporate change or re-organization; a third party or parties, where the individual consents to such disclosure or disclosure is required or permitted by law.

Use of Personal Information.

Big SNOW is responsible for personal information in its possession or under its control. Big SNOW shall take appropriate and reasonable steps to protect personal information against such risks as loss or theft, unauthorized access, disclosure, copying, use, modification or destruction. Any and all personal information collected will be used only by Big SNOW and its affiliated entities. Except as otherwise described in this Privacy Policy statement, personal information collected by any means will not be shared outside of Big SNOW and its affiliated entities without your consent. Big SNOW shall use appropriate means to protect personal information while information is being processed by a third party on behalf of Big SNOW.

Your Rights.

You have the right to “opt-out” of our collection of personal data at any time. Should you desire to so, please contact us at [email protected] to ensure that we do not continue to collect and store your personal information.

You also have the right to access your personal information. Should you wish to access your personal data which we have stored, please contact us at the provided contact information and we will respond to your request within seven (7) business days.

You have the right to be forgotten within Big SNOW’s personal information storage system. If you request to be forgotten, the Company will erase all of your personal data which it currently has. Moving forward, you will need to expressly consent to the collection of information again if you wish to do so in the future. Please note that if you request to be forgotten, your personal needs and preferences will disappear from Big SNOW’s records in the future, and the website will not be tailored to best suit your needs. Should you wish to be “forgotten”, please contact us at the provided contact information and we will respond to your request within fourteen (14) business days.

Breach of Data Storage.

While Big SNOW shall do everything in its power to protect your data, there is a chance that a breach may occur. Big SNOW’s policy for any data breach is as follows: 1.) We shall determine the time of breach, what data was breached and the severity of the data breach; 2.)We shall call an emergency meeting including the Data Protection Officer and other relevant departments to discuss the necessary course of action; 3.) We shall determine how the data was compromised and take any and all necessary steps to correct; We shall discuss the breach and the corrective steps taken directly with any third parties and any individuals, as needed.

This policy is subject to change and may be supplemented or modified by additional terms applicable between Big SNOW and an individual. We shall notify you if any changes are made.

Security and SSL

Protecting your order information is a priority for us. We use Secure Sockets Layer (SSL) technology to protect the security of your online order information. 

To check the security of your connection, look at the lower left-hand or right-hand corner of your browser window after accessing the e-commerce server. If you see an unbroken key or a closed lock (depending on your browser), then SSL is active and the server is secure. You can also double-check by looking at the URL line of your browser. When accessing a secure server, the first characters of the site address will change from “http” to “https.” 

Some versions of browsers and some firewalls do not permit communication through secure servers. In that case, you may not be able to connect to the server and therefore may not be able to place an order through an insecure connection. Children and Privacy

Big SNOW is concerned about the safety of children when they use the Internet. We encourage parents and guardians to spend time with their children online and to be familiar with the sites their children visit. We will never knowingly request personally identifiable information from anyone under the age of 13 without prior verifiable parental consent. If we become aware that a customer is under the age of 13 and has submitted personal information to us without prior verifiable parental consent, we will remove his or her personally identifiable information from our files.

Occasionally we provide links to other sites we think you will enjoy. These sites operate independently of Big SNOW and have established their own privacy and security policies. For the best online experience, we strongly encourage you to review these policies at any site you visit.

Big SNOW Guest Photo Policy

The person using a ticket or admission product to Big SNOW grants permission to Big SNOW to use his/her image in advertising and promotional materials without prior notification and without payment.

Drug & Alcohol Policy

Outside alcoholic beverages are not permitted in the premises. No drug use of any kind is tolerated in the premises. Big Snow reserves the right to search any bag, backpack or purse. Violators will be subject to immediate removal.

Equipment Policies

Big SNOW’s trails are designed for use by guests using alpine ski, snowboard and ski bike equipment that is affixed to the their feet by a wide range of binding systems and standardized adaptive devices for individuals with disabilities. All snow sliding equipment being used at Big SNOW must have metal edges. Sleds, toboggans and other snow play toys are not permitted on the slopes at Big SNOW.

Ski Bikes

Big SNOW allows the use of Sno-Go brand ski bikes. Riders must be attached to the device via a leash at all times while on snow and on the lifts.

Snow Skates & Scooters

Big SNOW allows the use of bi-level snow skates, and snow scooters provided they have metal edges. Riders must be attached to the device via a leash at all times while on snow and on the lifts.

Big SNOW reserves the right to refuse the use and access of any equipment it deems to be unsafe to the user or their guests.

The policies above are subject to change at Big SNOW’s discretion.

Prohibited Conduct

Conduct that is disorderly, disruptive or which interferes with or endangers any other guests or team members, or that is destructive to any property or operations within Big Snow American Dream or anywhere else on American Dream property.

The sale of goods or services, or the display of goods or services, unless prior written approval has been obtained.

Shooting of photos or videos of the property, team members or the operations at Big Snow American Dream for commercial purposes without the prior written consent of Big Snow American Dream.

Failing to adhere to your allocated time on snow

Multi-Visit Cardholders: For 3-Visit Rental and 6 or 10-Pack Ticket Cardholders, a second visit will be deducted once your card is scanned beyond each 2-hour session , it is the guest’s responsibility to keep track of your time.

Failing to leave the property promptly at the end of your allocated times, or at the time of closure of business, or as otherwise directed by Big Snow American Dream Team Members.

Smoking, vaping, or the consumption of alcoholic beverages while anywhere on Big SNOW premises.

Private Instruction

The for profit teaching or instruction of other Big SNOW guests on our slopes is prohibited unless authorized by Big SNOW in advance. Big SNOW reserves the right to remove any guest participating in these activities.

Clothing/Attire

Appropriate attire, including shirts and shoes, must be worn.

We reserve the right to deny admission to or remove any person wearing attire that we consider inappropriate, offensive, or that we feel could detract from the experience of other Big SNOW guests.

Violations of the Law

The commission of any act defined by federal, state, county or local statutes, regulations or ordinances as a criminal act is prohibited.

Guns, knives, batons, tasers and other weapons (or replicas of weapons) are banned within the Center or anywhere on Big SNOW and American Dream property.

Service Animals

Only service animals trained to do work or perform tasks for an individual with a disability are permitted within the Center or anywhere on Big SNOW or American Dream property.

Big SNOW Terms of Use

By accepting a ticket to Big SNOW American Dream, I accept and agree to the following WARNINGS: I understand that fencing and padding is primarily used throughout the premises as visual warnings and I RECOGNIZE THAT SERIOUS INJURY OR DEATH CAN RESULT FROM CONTACT WITH FENCING OR PADDED EQUIPMENT. I agree to observe the SKIER’S RESPONSIBILITY CODE at all times.

New Jersey Law requires all ski & snowboard participants age 17 & under to wear a securely fitted helmet while on the trails and lifts.

I acknowledge that Big SNOW American Dream is an Alpine environment; ice, snow, slippery and irregular conditions may exist at any time on any surface, including paths and flooring around the area.

I AGREE that EXCLUSIVE JURISDICTION of all disputes between myself and Big SNOW American Dream shall be in the State and Federal Courts of the State of New Jersey and venue in the state court shall be ‘MORRIS COUNTY’. By accepting this ticket, I authorize Big SNOW to record and reproduce my image and/or performance in the company’s promotional material.
